Terms of Service
These Terms of Service ("Terms") govern your use of OpinionPick, a social entertainment platform for settling friendly arguments. By using OpinionPick you agree to be bound by these Terms.
01 Acceptance of terms
By creating an account, joining a case, or using any feature of OpinionPick ("Service"), you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, please do not use the Service. You must be aged 18 or over to use the Service.
02 What OpinionPick is and is not
OpinionPick is a social entertainment platform for settling friendly arguments and casual challenges. It is not, and must never be used as:
- a legal, arbitration, mediation, or alternative dispute resolution service;
- a regulated gambling or betting service;
- a court, tribunal, or replacement for any formal legal process;
- a consumer financial product, investment vehicle, or financial advice service; or
- a venue for resolving real legal or financial disputes between parties.
Verdicts issued on OpinionPick are entertainment and have no legal force whatsoever.
03 Eligibility and accounts
You must be at least 18 years old to use OpinionPick. By registering you confirm you meet this requirement. You agree to provide accurate, complete, and current registration information. You may hold only one account at a time. You are responsible for all activity under your account and for keeping your login credentials secure. Notify us immediately at [email protected] if you suspect your account has been compromised.
04 Challenges and cases
Two modes are available:
- Blitz cases: instant, self-resolved challenges for spur-of-the-moment disputes. No evidence phase; outcome agreed between the parties.
- Standard cases: include an evidence submission phase, an optional service fee, and access to the full resolution ladder (Self → AI verdict → Community Jurors → Tribunal).
When you create a case, you set the time limit, service fee tier, and optional forfeit. Your opponent must actively accept the case for it to go live. If your opponent does not accept within the time limit, no fee is charged and no forfeit is owed. You are solely responsible for the content of the cases you create and confirm that content does not violate section 11 (Prohibited uses) of these Terms.
05 Service fees and payment
Service fees are optional. You and your opponent choose a fee tier (£0, £1, £5, or £10 — subject to regional availability) when a case begins. Both parties authorise a payment hold for the agreed tier via Stripe, our payment processor. This hold is an authorisation only — it is not an immediate charge.
On the verdict:
- Only the losing party's hold is captured as a service fee.
- The winning party's hold is released immediately.
If a case escalates through the resolution ladder (AI verdict, Community Jurors, Tribunal), additional fees apply at each tier. You will always see the next tier's cost before you choose to escalate. All escalation fees are charged to the losing party only. No refunds are available once a verdict has been issued. If a payment fails or is disputed after authorisation, any pending forfeit obligation is voided. Available fee tiers may vary by region.
06 Points
Winners of cases earn reward points. Points:
- have no monetary value and are not a financial instrument of any kind;
- are personal to your account and cannot be transferred to another user;
- cannot be exchanged, redeemed, or withdrawn for cash or any other currency;
- expire upon permanent closure or termination of your account; and
- may be spent in the Shop to redeem cosmetic items (themes, avatar frames, name colours, status badges, and reaction packs).
Points balances may be adjusted by OpinionPick at any time for platform integrity reasons, including correction of errors or enforcement action.
07 Forfeits and conduct
Forfeits are optional social consequences agreed before a case begins. All forfeits in our standard library are moderated to be awkward-funny and never harmful, dangerous, sexual, or coercive. Custom forfeit text is screened before activation and may be rejected without explanation.
Key rules:
- Forfeits are voluntary social agreements between participants only.
- No forfeit carries any legal force. No party may seek legal enforcement of a forfeit.
- Any party may decline or report a forfeit they consider unsafe using the in-app report function.
- OpinionPick is not liable for any forfeit, even one selected from our library.
08 Community Jurors
Community Jurors are volunteer members who review cases and deliver verdicts when parties cannot agree. By participating as a Juror you confirm:
- You are a volunteer and not an employee, worker, or agent of OpinionPick.
- You will not receive wages, salary, or any cash compensation.
- Points and rank earned for accurate judging have no monetary value (see section 06).
- Your decisions are part of the game mechanic only and carry no legal force.
- You will judge cases impartially and will not trade, sell, or promise verdicts in exchange for anything of value.
OpinionPick may suspend or permanently remove Juror status at any time without notice.
09 User content and licence
You own the content you submit to OpinionPick ("Your Content"). By submitting Your Content, you grant OpinionPick a limited, worldwide, royalty-free, non-exclusive, sublicensable (to our sub-processors only) licence to store, display, reproduce, and process Your Content solely for the purpose of operating the Service. This licence ends when Your Content is deleted, subject to the retention periods set out in our Privacy Policy.
You confirm that you have all necessary rights to submit Your Content, that it does not infringe any third-party intellectual property, privacy, or other rights, and that it does not contain special-category personal data. 10 Intellectual property
All code, design, trademarks, logos, trade dress, and original content created by OpinionPick is owned by or licensed to OpinionPick and protected by applicable intellectual property laws. You may not copy, reproduce, scrape, reverse engineer, or otherwise exploit any part of the Service without our prior written permission. Nothing in these Terms transfers any OpinionPick intellectual property rights to you.
11 Prohibited uses
You agree not to use OpinionPick to:
- submit, create, or participate in cases involving real legal, financial, or contractual disputes between parties;
- harass, abuse, threaten, stalk, or target any person;
- submit content that is hateful, discriminatory, or incites violence against any group;
- allow anyone under 18 to use your account or create cases on your behalf;
- impersonate any person or organisation;
- create fake accounts or use bots, scripts, or automated tools to interact with the Service;
- scrape, crawl, or harvest data from the Service by automated means;
- submit harmful, dangerous, or illegal dares or challenges;
- submit sexual, coercive, or exploitative content;
- attempt to enforce a verdict or forfeit through legal or other means outside the platform;
- attempt to circumvent safety measures, moderation systems, or account restrictions; or
- use the Service for any commercial purpose without our prior written consent.
Violations may result in content removal, account suspension, or permanent termination.
12 No legal effect
Verdicts issued on OpinionPick — whether by mutual agreement, AI analysis, Community Jurors, or Tribunal — are a game mechanic constituting the aggregated opinion of participants. They are not findings of fact, legal rulings, judgments, or orders; not binding arbitration or mediation decisions; and not evidence in any legal proceeding. No verdict issued on OpinionPick is enforceable in any court or legal forum. For real disputes, please consult a qualified legal professional.
13 Copyright and takedown notices
If you believe content on OpinionPick infringes your copyright or other intellectual property rights, please follow the procedure set out on our Intellectual Property & Copyright page. We respond to all valid notices within 5 working days.
14 Limitation of liability
To the fullest extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied.
- OpinionPick makes no warranty that the Service will be uninterrupted, error-free, or free of harmful components.
- OpinionPick is not liable for any indirect, incidental, special, consequential, or punitive losses arising from your use of the Service, including loss of data, loss of profits, or loss of goodwill.
- OpinionPick's total liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the greater of £10 or the total service fees you paid in the three months immediately before the claim arose.
Nothing in these Terms limits or excludes liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited, including rights you may have under the Consumer Rights Act 2015.
15 Indemnification
You agree to indemnify, defend, and hold harmless OpinionPick and its officers, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms; or (d) your infringement of any third-party rights. OpinionPick reserves the right to assume exclusive control of any matter subject to indemnification, in which case you agree to cooperate with our defence of that matter.
16 Governing law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the non-exclusive jurisdiction of the courts of England and Wales, without prejudice to OpinionPick's right to seek urgent injunctive or other equitable relief in any competent jurisdiction.
17 Changes to these terms
We may update these Terms from time to time. For material changes we will give you at least 14 days' notice by email or in-app notification before the change takes effect. The "last updated" date at the top of this page will reflect the most recent revision. Continued use of the Service after the notice period constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
